2-102.11 Demonstration-
The PIC was not a certified food protection manager, there were multiple priority violations observed, and could not respond to all of the inspector's questions. CDI - REHS explained each violation to the PIC.
Based on the RISKS inherent to the FOOD operation, during inspections and upon request the PERSON IN CHARGE shall demonstrate this knowledge by:
(A) Complying with this Code by having no PRIORITY violations.
(B) Being a certified FOOD protection manager

(B) A HANDWASHING SINK may not be used for purposes other than handwashing. (PF)
6-301.11 Handwashing Cleanser, Availability-
There was no soap present at the front handwashing sink in the kitchen at the start the inspection. CDI - PIC provided soap to the handwashing sink.
Each HANDWASHING SINK or group of 2 adjacent HANDWASHING SINKS shall be provided with a supply of hand cleaning liquid, powder, or bar soap. (PF) |

Unwashed produce was observed stored above ready to eat food in the walk in cooler in multiple locations. Multiple instances of washed produce being stored in non-sealed containers with no protection in the walk in cooler. Chili sauce that was not cooling or in-use was found without a cover in the bottom of the right fliptop cooler.
(A) FOOD shall be protected from cross contamination by:

3-501.19-Time as a Public Health Control-
Facility is using TPHC for their cut cabbage and bean sprouts but does not have any written procedures for doing this. There was no labeling method taking place to keep track of the time. CDI - PIC and REHS drafted procedures during the inspection.
(A) If time without temperature control is used as the public health control for a working supply of TIME/TEMPERATURE CONTROL FOR SAFETY FOOD before cooking, or for READY-TO-EAT TIME/TEMPERATURE CONTROL FOR SAFETY FOOD that is displayed or held for sale or service:
(1) Written procedures shall be prepared in advance, maintained in the FOOD ESTABLISHMENT and made available to the REGULATORY AUTHORITY upon request that specify:
(a) Methods of compliance with Subparagraphs (B)(1)-(4) or (C)(1)-(5) of this section; and

Observed a knife stored in the crevice between the fliptop cooler and low boy cooler. In-use utensils cannot be stored there because that area is not a clean portion of equipment.

Observed two containers that were cracked and thus no longer easily cleanable. CDI - PIC voluntarily discarded the containers.
Multiuse food-contact surfaces shall be smooth and free of breaks, open seams, cracks, chips, inclusions, pits, sharp internal angles, corners, crevices and be finished to have smooth welds and joints. They must also be accessible for cleaning and inspection. Pf
4-402.11 Fixed Equipment, Spacing or Sealing-
Observed one of the restroom sinks coming off the wall. Re-caulk sink.
(A) EQUIPMENT that is fixed because it is not EASILY MOVABLE shall be installed so that it is:
(1) Spaced to allow access for cleaning along the sides, behind, and above the EQUIPMENT;
(2) Spaced from adjoining EQUIPMENT, walls, and ceilings a distance of not more than 1 millimeter or one thirty-second inch; or
(3) SEALED to adjoining EQUIPMENT or walls, if the EQUIPMENT is exposed to spillage or seepage.
(B) COUNTER-MOUNTED EQUIPMENT that is not EASILY MOVABLE shall be installed to allow cleaning of the EQUIPMENT and areas underneath and around the EQUIPMENT by being:
(1) SEALED; or
(2) Elevated on legs as specified under 4-402.12(D). |

Facility does not have any quat test strips, which are used for the 3 compartment sink and sanitizer buckets. CDI - REHS left the facility with some more to use in the meantime.
A test kit or other device that accurately measures the concentration in MG/L of SANITIZING solutions shall be provided.
4-501.16 Warewashing Sinks, Use Limitation.
Observed the facility not clean or sanitize the 3 compartment sink in between using it for food prep and using it for warewashing. PIC emptied sink compartments to be cleaned and sanitized during the inspection.
(A) A WAREWASHING sink may not be used for handwashing as specified under § 2-301.15.
(B) If a WAREWASHING sink is used to wash wiping cloths, wash produce, or thaw FOOD, the sink shall be cleaned as specified under § 4-501.14 before and after each time it is used to wash wiping cloths or wash produce or thaw FOOD. Sinks used to wash or thaw FOOD shall be SANITIZED as specified under Part 4-7 before and after using the sink to wash produce or thaw FOOD. C |
